General Terms and Conditions of the Package Travel Contract:

 

a) General introductory information regarding the interpretation of terms and the application of the contract

1) These general terms and conditions contain important information that the travel organizer, TC Travel Agency, Zagreb, Perašćanski put 6a, 10 040 Zagreb, registered in the Trade Register under number 98837605 (hereinafter referred to as "the organizer"), is obliged to provide to the traveler in accordance with the provisions of the Tourism Services Act. As such, they form an integral part of the package travel contract.

2) The traveler is obliged to carefully review the contents of these General Terms and the separately provided standard information for package travel contracts, prescribed by the relevant annexes of the Tourism Services Act, before committing to the contract in any way. The scope of information in these documents and the time required to familiarize oneself with them cannot serve as grounds for claiming that the traveler was unable to adequately review them.

3) A traveler is any person who intends to enter into a package travel contract or is entitled to travel under an already concluded package travel contract. A traveler entering into such a contract assumes the obligation to inform all individuals entitled to travel under the contract about the rights and obligations arising from the terms of the package travel contract, as well as any additional information provided through personal contact with the organizer's representatives or via email.

4) When registering, the traveler entering into a package travel contract is obligated to provide the travel organizer with information and, if necessary, submit documents for all travelers using the package travel services. These include information essential for the implementation of the package travel arrangement (personal documents and/or data from personal documents, vaccination certificates, health information, habits, or other limitations that may affect the execution of the package travel arrangement). The organizer is not responsible for any consequences or costs arising from the failure to inform the travel organizer and/or the provision of incorrect information; such responsibilities rest solely with the traveler entering into the package travel contract.

5) The traveler entering into a package travel contract guarantees that they are authorized by the travelers using the package travel services to provide the travel organizer with their documents, personal data, and other necessary information and that they are authorized to enter into the package travel contract on their behalf.

6) The traveler is obliged to meet all the requirements of the destination country regarding passports, visas, and health formalities specified in the pre-contractual information in a timely manner before the trip. During the trip, the traveler must carry all necessary travel documents, including appropriate certificates confirming compliance with health formalities, and present them to the competent officials upon request.

7) In the event of the loss of travel documents or a violation of foreign exchange, customs, or other regulations of the destination country, the organizer will provide the traveler with appropriate assistance as stipulated by the applicable regulations for travelers in difficulty. The traveler is responsible for covering the costs of such assistance as well as any travel-related expenses necessary for the continuation of the package travel arrangement or return to the point of departure.

8) The organizer, in accordance with the provisions of the Tourism Services Act, assumes all responsibilities arising from the combination and sale of at least two different travel services within a package travel arrangement, regardless of whether the contract covers all travel services as a whole or the package travel arrangement is provided through separate contracts for individual travel services.

9) The travel services combined by the organizer within a package travel arrangement primarily include passenger transportation services, accommodation that is not an integral part of passenger transportation and is not for residential purposes, car rental, rental of other motorized vehicles with at least four wheels and a speed exceeding 25 km/h, or motorcycles requiring a category A driver's license. Travel services also include other tourist services provided they are not an integral part of the aforementioned services.

10) A combination of a single transportation service, accommodation, or vehicle rental with one or more other tourist services is not considered a package travel arrangement if the other tourist services do not constitute more than 25% of the total value of the combination, are not advertised as an essential feature of the combination, nor otherwise represent a significant aspect of the combination, or if they are selected and purchased only after the transportation, accommodation, or vehicle rental service has commenced.

11) The provisions of these general terms and conditions do not apply to combinations of travel services that are not intended for the same trip or holiday, that cover a period of less than 24 hours unless overnight accommodation is included, or that are purchased under a general agreement for organizing business travel.

12) The package travel contract is considered binding once it has been signed by the contracting parties and provided to the traveler in written form, or once the traveler booking the package travel has submitted all necessary information about the travelers and explicitly confirmed their agreement with the provided contractual information via email, an online package travel booking interface, fax, or another means of remote communication. If the traveler booking the package travel, after receiving the contractual information and submitting all necessary traveler details, provides the organizer with a credit card number for payment of the package or makes a payment to the organizer's bank account, the contract shall be deemed concluded even without any further explicit declaration by the traveler.

13) The package travel contract takes legal effect once the organizer receives the full agreed amount by the specified deadline or, if agreed otherwise, a portion of the amount, with the remainder to be paid within the timeframes and in the manner specifically outlined in the contract.

14) These general terms and conditions apply from 29 October 2024, and travelers will be appropriately informed of their application before entering into a package travel contract. For all package travel arrangements for which contracts were concluded before the commencement of these general terms and conditions, the provisions of the general terms and conditions in effect at the time the contract was concluded shall apply.

15) In the event of a dispute that cannot be resolved amicably or through mechanisms for alternative dispute resolution, the applicable law and jurisdiction of the court shall be that of the location of the travel organizer's headquarters.

16) The terms used in this document that have gender significance apply equally to both masculine and feminine genders.

 

b) Responsibilities and Obligations of the Organizer and the Traveler

17) The organizer is responsible for the performance of travel services included in the package travel contract, regardless of whether the services are performed by the organizer itself or by other travel service providers.

18) The traveler is obliged, without undue delay and taking into account the circumstances, to inform the organizer of any non-conformity identified during the performance of travel services included in the package travel contract.

19) If any of the travel services are not performed in accordance with the package travel contract, the organizer shall, at the traveler's request, remedy the non-conformity, unless this is impossible or if remedying the non-conformity would result in disproportionate costs taking into account the extent of the non-conformity and the value of the travel services affected.

20) If the organizer fails to remedy the non-conformity for the reasons stated in the previous clause of these General Terms and Conditions, the traveler is entitled to a price reduction and compensation in accordance with the provisions of these General Terms and Conditions governing the right to a price reduction and compensation. 

21) If the organizer fails to remedy the non-conformity within a reasonable time specified by the traveler, the traveler may remedy it themselves and claim reimbursement for the necessary expenses. The traveler is not obliged to specify a reasonable time limit for the organizer to remedy the non-conformity if the organizer has refused to remedy the non-conformity or if the non-conformity needs to be remedied immediately.

22) If a significant part of the travel services cannot be provided in accordance with the package travel contract, the organizer shall, in order to continue the package travel, offer the traveler suitable alternative arrangements, if possible of equal or higher quality than those specified in the contract, at no additional cost to the traveler, including in the event that the traveler is not returned to the place of departure as agreed.

23) If the organizer proposes an alternative travel arrangement that results in a package travel of lower quality than that specified in the package travel contract, the organizer shall grant the traveler an appropriate price reduction.

24) The traveler may refuse the proposed alternative travel arrangements only if they are not comparable to what was agreed upon in the package travel contract or if the granted price reduction is inappropriate.

25) If the non-conformity significantly affects the performance of the package travel and if the organizer has not remedied the non-conformity within a reasonable time specified by the traveler, the traveler may terminate the package travel contract without paying a termination fee and may claim, if necessary, a price reduction and/or compensation in accordance with the provisions of these General Terms and Conditions governing the right to a price reduction and compensation.

26) If it is not possible to provide alternative arrangements, or if the traveler refuses the proposed alternative arrangements in accordance with these General Terms and Conditions, the traveler is entitled, as appropriate, to a price reduction and/or compensation in accordance with the provisions of these General Terms and Conditions governing the right to a price reduction and compensation.

27) If the package includes the transportation of passengers, in the cases referred to in the previous two points of these General Terms and Conditions, the organizer shall ensure the repatriation of the passenger by equivalent transportation without undue delay and at no additional cost to the passenger. Additional costs shall be borne by the organizer.

28) Where, due to extraordinary circumstances which could not have been avoided, it is impossible to ensure the return of the passenger in accordance with the package travel contract, the organizer shall bear the costs of necessary accommodation for a maximum of three nights per passenger, if possible in equivalent accommodation as agreed in the contract. If the legislation of the European Union on passenger rights applicable to the relevant means of transport for the return of passengers provides for longer periods, those periods shall apply.

29) The cost limitation referred to in the preceding article of these General Terms and Conditions shall not apply to persons with reduced mobility as defined in Article 2(a) of Regulation (EC) No 1107/2006 of the European Parliament and of the Council of 5 July 2006 concerning the rights of disabled persons and persons with reduced mobility when travelling by air (OJ L 204, 26.7.2006), and to any person accompanying them, to pregnant women, unaccompanied minors, and to persons requiring special assistance, provided that the organizer has been notified of such special needs at least 48 hours prior to the commencement of the package travel.

30) The organizer shall not rely on force majeure to limit its liability under these General Terms and Conditions if the transport provider is unable to rely on such circumstances under applicable European Union law.

31) The traveler shall be entitled to a reasonable reduction in the price paid for any period during which there was a failure to comply with the contract for the package travel, unless the organizer can demonstrate that such failure was attributable to the traveler.

32) Regardless of any price reduction or termination of the contract, the traveler shall be entitled to claim from the organizer appropriate compensation for any loss or damage suffered as a result of any non-conformity, and the organizer shall compensate the traveler for such loss or damage without undue delay.

33) The organizer shall not be liable for damages if it can demonstrate that the non-conformity is attributable to the traveler or that the non-conformity is attributable to a third party not connected with the provision of travel services covered by the package travel contract and that the non-conformity was unforeseeable or unavoidable or that the non-conformity arose due to force majeure.

34) The organizer shall limit its liability for damages, other than those resulting from bodily injury or caused intentionally or negligently by the organizer, to an amount equivalent to three times the total price of the package travel.

35) If international conventions binding the European Union or laws based on them limit the scope of compensation that a travel service provider forming part of a package travel arrangement is obliged to pay or restrict the conditions under which he is obliged to compensate for such damage, in such a case, the same assumptions, limitations and exclusions shall apply mutatis mutandis to the organizer and he may invoke this fact in relation to the traveler.

36) The traveler’s right to compensation or a price reduction prescribed by the Act on the Provision of Tourism Services and international conventions does not affect the traveler’s rights under Regulation (EC) No 261/2004 of the European Parliament and of the Council of 11 February 2004 establishing common rules on compensation and assistance to passengers in the event of denied boarding, flight cancellations, or long delays, and repealing Regulation (EEC) No 295/91; Regulation (EC) No 1371/2007 of the European Parliament and of the Council of 23 October 2007 on rail passengers’ rights and obligations; Regulation (EC) No 392/2009 of the European Parliament and of the Council of 23 April 2009 on the liability of carriers of passengers by sea in the event of accidents; Regulation (EU) No 1177/2010 of the European Parliament and of the Council of 24 November 2010 concerning the rights of passengers when traveling by sea and inland waterways and amending Regulation (EC) No 2006/2004; and Regulation (EU) No 181/2011 of the European Parliament and of the Council of 16 February 2011 concerning the rights of passengers in bus and coach transport and amending Regulation (EC) No 2006/2004.

37) The traveler has the right to submit claims for a price reduction and/or compensation in accordance with the Tourism Services Act and in accordance with international conventions and regulations as specified in the preceding clause of these General Terms and Conditions.

38) The right of the traveler to compensation or a price reduction pursuant to the Tourism Services Act and international conventions and regulations as specified in clause 20 of these General Terms and Conditions shall be mutually exclusive to avoid overcompensation and/or excessive price reduction.

39) The traveler's right to claim a price reduction based on the provisions of the Tourism Services Act governing amendments to package travel contracts before the start of the package travel, the performance of the package travel, and price reductions and compensation shall become time-barred within two years. The limitation period shall commence on the day following the day on which the package travel should have ended according to the contract.

40) The organizer shall provide appropriate assistance without undue delay to a traveler in difficulty, particularly in circumstances where, due to unavoidable and extraordinary circumstances, it is impossible to ensure the traveler's return as agreed in the package travel contract. Such assistance shall in particular consist of providing appropriate information on health services, local authorities, and consular assistance and helping the traveler to establish long-distance communication and find alternative travel arrangements.

41) If the traveler has caused the difficulty intentionally or through negligence, the organizer may charge a fee for the assistance provided under the preceding clause of these General Terms and Conditions, provided that the fee does not exceed the actual costs incurred by the organizer.

42) The central contact point for administrative cooperation with the central contact points of other Contracting States to the Agreement on the European Economic Area regarding insolvency protection, which the organizer is required to apply, is: Ministry of Tourism of the Republic of Croatia, Prisavlje 14, 10000 Zagreb, , +385 1 6169 111.

43) Pursuant to the provisions of the Tourism Services Act, the traveler has the right to submit written complaints in person at the organizer's office located at Perašćanski put 6a, 10 040 Zagreb, by post to the same address, by e-mail to . The organizer shall confirm receipt of a written complaint without undue delay and provide a written response within 15 days of receipt of the complaint.

44) In accordance with the special law on alternative dispute resolution for consumer disputes, the available mechanisms for alternative dispute resolution of consumer disputes include the possibility of initiating a dispute resolution procedure before an authorized body for alternative dispute resolution for consumer disputes to which the organizer is subject and through the online dispute resolution platform for services purchased online.

45) The authorized body for alternative dispute resolution for consumer disputes to which the organizer is subject is the Mediation Centre of the Croatian Chamber of Economy, located at Rooseveltov trg 2, 10000 Zagreb, 10000. 46) For services purchased online, the traveler may submit a complaint to an authorized alternative dispute resolution entity using the online dispute resolution platform available at the following web address: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=HR

47) Before the start of a package travel, the traveler may transfer the package travel contract to another person who meets all the conditions applicable to that contract, provided that the organizer is informed in writing on a durable medium and within a reasonable time before the start of the package travel. A notification sent to the organizer no later than seven days before the start of the package travel shall be considered a notification within a reasonable time.

48) Both the person transferring a package holiday and the person taking over the holiday are equally responsible for paying all costs related to the transfer.

49) The organizer shall inform the transferee of the costs of transferring the contract, which shall not exceed the actual cost to the organizer incurred by the transfer of the package travel contract. The organizer shall provide the transferee with evidence of any additional charges, fees, or other costs arising from the transfer of the package travel contract.

50) The customer may cancel the trip at any time before the start of the trip. Relevant for the timeliness of the cancellation statement is the receipt of the cancellation statement by the organizer. To avoid misunderstandings and for evidentiary reasons, we recommend that the cancellation be made on a durable medium.

51) If the customer cancels the travel contract or does not commence the trip, the organizer loses the right to the agreed travel price. Instead, the organizer may, if they are not responsible for the cancellation or non-commencement of the trip and if there are no unavoidable, extraordinary circumstances at the destination or its immediate vicinity that significantly hinder the implementation of the package or the transportation of persons to the destination, demand compensation for the travel preparations and expenses incurred (cancellation fees). When calculating the compensation, the usual savings of the organizer and the usual possible alternative use of the travel services must be taken into account. If not otherwise stated in the pre-contractual information (travel information on the travel website), the organizer may calculate their compensation as a percentage of the agreed travel price, taking into account the proximity of the cancellation to the agreed start of the trip:

  • up to the 30th day before the start of the trip 20% of the travel price
  • from the 29th to the 22nd day before the start of the trip 30% of the travel price
  • from the 21st to the 15th day before the start of the trip 40% of the travel price
  • from the 14th to the 7th day before the start of the trip 50% of the travel price
  • from the 6th day before the start of the trip 55% of the travel price
  • in case of non-commencement of the trip 75% of the travel price

 

c) Provision of a package holiday and the features of the transportation

52) The organizer shall use for the provision of transportation services within the package tour, transportation means of carriers that hold the appropriate licenses in accordance with the special regulations governing the individual type of transport. Unless expressly stated otherwise in the pre-contractual information, the organizer shall use vehicles with air-conditioned passenger cabins and a public address system, and seats with reclining capabilities and at least one armrest. In the case of bus transport, unless expressly stated otherwise in the pre-contractual information, the organizer reserves the right to use minibuses, low-floor, high-floor and double-decker buses, and some seats may face opposite to the direction of travel. In the case of air transport, unless expressly stated otherwise in the pre-contractation information, the organizer reserves the right to use all aircraft in the carrier's fleet, including those powered by turboprop engines, and the seats may be arranged in rows of 2, 3 or more seats depending on the aircraft model.

53) For each package travel organized for groups, unless explicitly stated otherwise in the pre-contractual information, the organizer will assign one travel leader for every group of 15 to 75 travelers, who will provide their services in the Croatian language. For the provision of tour guide services included in the package travel, the organizer will engage authorized tour guides who will provide commentary in Croatian. For trips abroad, commentary will be provided in the official language of the tourist destination or in English, with consecutive translation by the travel leader into Croatian, unless explicitly stated otherwise in the pre-contractual information.

54) All other tourist services that require effective verbal communication will be provided in the official language of the tourist destination, unless expressly stated otherwise in the pre-contractual information.

55) The travel services included in the package tour are generally not suitable for persons with reduced mobility unless expressly stated otherwise in the pre-contractual information. At the request of the traveler, the organizer will provide more detailed information on the suitability of the trip or holiday, taking into account the traveler's needs.

56) Payment for the package tour can only be made by bank transfer to the organizer's transaction account, based on the payment request and within the specified timeframe.

57) Upon signing the contract, or no later than 5 working days after signing the contract, a down payment of at least 30% of the package tour price must be paid. The remaining amount must be paid at least 14 days before the departure date, unless expressly stated otherwise in the pre-contractual information. In the event of a contract being concluded within a shorter period than that required for the payment of the remaining amount, the organizer has the right to request payment of the entire package tour price upon signing the contract. Depending on the conditions offered by credit and bank card issuers, payment in installments may be possible, but the card must be charged for the entire installment plan upon signing the contract.

58) For each group package tour, the organizer will specify in the pre-contractual information the minimum number of persons required for the package tour to take place. If this number is not reached, the organizer reserves the right to terminate the package travel contract before the start of the package tour, and shall notify the traveler at least twenty days before the start of the package tour for tours lasting more than six days, seven days before the start of the package tour for tours lasting between two and six days, and 48 hours before the start of the package tour for tours lasting less than two days.

59) General information about the destination country's requirements regarding passports and visas, the approximate duration of the visa application process, and health formalities indicated in the pre-contractual information apply exclusively to citizens of the Republic of Croatia. If this information is not specifically indicated in the pre-contractual information, it means that 1  there are no special requirements for citizens of the Republic of Croatia for the destination country, except for holding a valid identity card.

60) If a traveler who is not a citizen of the Republic of Croatia intends to use the package travel services, they are obliged to inform the organizer before concluding the contract and state their citizenship in order to obtain general information about the destination country's requirements regarding passports and visas, the approximate duration of the visa application process, and health formalities.

61) A traveler may terminate the package travel contract at any time before the start of the package tour. If the standard cancellation fees are not expressly indicated in the pre-contractual information, the organizer shall determine the amount of the cancellation fee by reducing the price of the package tour by the amount of the savings in its costs, or by the income from providing the same travel services to another user that it would have realized at the latest 2 working days before the deadline for returning the payments made to the traveler minus the cancellation fee.

62) An integral part of these General Terms and Conditions is the information on insurance to cover the costs of contract termination by the traveler and the costs of providing assistance, including repatriation, in the event of an accident, illness, or death, particularly in terms of the content and conditions of the insurance with which the organizer has separately acquainted the traveler.

63) The insolvency guarantee is provided by Generali osiguranje d.d., OIB: 10840749604, under policy number 1025952328. In the event of a claim under the guarantee, travelers should contact the insurer directly at Slavonska avenija 1b, 10000 Zagreb, Hrvatska, by email , or by phone at +385 (0)1 4600 400.

64) The organizer has taken out liability insurance with Generali osiguranje d.d., OIB: 10840749604, under policy number 1025952327, to cover any damages caused to the traveler due to non-performance, partial performance, or improper performance of obligations related to the package tour. In the event of a claim, travelers should contact the insurer directly at at Slavonska avenija 1b, 10000 Zagreb, Hrvatska, by email , or by phone at +385 (0)1 4600 400.

65) The organizer, TC Travel, OIB: 23512584611, Company registration number: 98837605, has established its own service enabling travelers to quickly contact the relevant employees of the organizer and communicate effectively with them in order to seek assistance if they find themselves in difficulty or to report any discrepancies they identify during the execution of the package travel. Unless explicitly stated otherwise in the contract, the following contact details are available to the traveler for communication with the organizer: phone: +385 91 8851 499, email: .

66) In the event that a minor without the accompaniment of a parent or other authorized person travels under a package travel contract that includes accommodation, direct contact with the minor or the person responsible for the minor at the minor's place of stay can be established by contacting the organizer's service as specified in the previous point of these General Terms and Conditions, which enables the traveler to seek assistance in case of difficulties and to report any discrepancies.

 

d) General information in terms of partial interpretation of certain procedures under the Act on the Provision of Tourism Services

67) All pre-contractual information provided to the traveler by the organizer shall form an integral part of the package travel contract. However, the organizer may amend such information before the conclusion of the contract, provided that the traveler is notified of all changes in a clear, comprehensible and easily identifiable manner.

68) The travel organizer shall provide the traveler with a copy of the package travel contract in electronic form at the time of its conclusion or without undue delay thereafter, either by email or by storing it on the traveler's portable data storage medium. If the package travel contract is concluded in the organizer's premises in the physical presence of the contracting parties, the travel organizer shall, at the traveler's request, provide a paper copy of the contract.

69) No later than 3 days prior to the departure date, the organizer shall send the traveler an email containing information on the scheduled departure times and, if necessary, the registration deadline, as well as on the scheduled times for stopovers, transportation, and arrival. The email shall also include information on where and how to collect any necessary receipts, vouchers, and tickets that cannot be sent electronically. If the traveler does not receive the required information within the specified period or cannot access their email address for any reason, they must notify the organizer immediately so that the organizer can provide the information by other means.

70) The organizer reserves the right to increase the total price of the package by up to 8% if there is a change in the price of passenger transport resulting from changes in fuel or other energy costs, to the extent that carriers increase their prices for the same reasons. If the pre-contractual information does not explicitly state the proportion of transportation costs in the total price of the package, and if the organizer does not have a basis for calculating the price adjustment, the organizer will not increase the price as a result of changes in transportation costs.

71) The organizer reserves the right to increase the total price of the package by up to 8% if there is a change in the amount of taxes or fees for travel services included in the contract, which are determined by third parties not directly involved in the performance of the package, including tourist taxes, landing fees, or embarkation or disembarkation fees at ports and airports. If the pre-contractual information does not explicitly state the proportion or value of such taxes or fees in the total price of the package, and if the organizer does not have a basis for calculating the price adjustment, the organizer will not increase the price as a result of changes in the amount of taxes or fees.

72) The organizer reserves the right to increase the total price of the package by up to 8% if there is a change in the price of passenger transport resulting from changes in fuel or other energy costs, to the extent that carriers increase their prices for the same reasons. If the pre-contractual information does not explicitly state the proportion of transportation costs in the total price of the package, and if the organizer does not have a basis for calculating the price adjustment, the organizer will not increase the price as a result of changes in transportation costs.

73) If there is a need to increase the price of the package, the organizer will, at the latest 20 days before the start of the package, send a corresponding notification of the price increase to the passenger's e-mail address, along with an explanation and calculation of the increase.

74) If the pre-contractual information includes details on the possibility and method of calculating price changes in the event of price reductions, the organizer will refund the resulting price difference to the passenger, minus the administrative costs of the calculation by an authorized court expert. If the administrative costs of calculating the difference exceed the amount that the organizer should refund, the passenger is obliged to cover the resulting difference at their own expense. The tour operator will inform the passenger in advance of the approximate costs of the calculation.

75) The tour operator reserves the right to unilaterally modify other terms of the package travel contract before the start of the package if it is a minor change that does not affect the main characteristics of the trip in a way that lowers the quality or value of the travel services or causes significant inconvenience or additional costs to the traveler. The organizer will send the traveler a corresponding notification by email of changes that are considered minor.

76) If, before the start of the package, the tour operator must significantly change any of the essential characteristics of the travel services or cannot fulfill the traveler's special requirements specified in the contract, the tour operator will send a corresponding notification to the traveler's email address. This notification will include information about the proposed changes, their impact on the price of the package, and any alternative packages, as well as the deadline by which the traveler must inform the organizer of their acceptance or rejection of the proposed change or alternative package, and the consequences if the traveler fails to respond within the deadline or rejects the proposed changes.

77) The tour operator may terminate the package travel contract before the start of the package and fully refund all payments received for the package to the traveler, without being obliged to compensate the traveler for damages, if the organizer is prevented from performing the contract due to extraordinary circumstances that could not have been avoided. If such circumstances occur, the organizer shall notify the traveler by email of the termination of the contract without undue delay before the start of the package.

78) The traveler has the right to terminate the package travel contract before the start of the package without paying any cancellation fee in the event of extraordinary circumstances that could not have been avoided, which have occurred at the destination or in its immediate vicinity and which significantly affect the performance of the package or significantly affect the transportation of the traveler to the destination. When assessing the level of impact of extraordinary circumstances on the performance of the package or the transportation of the traveler to the destination, the assessments of the competent public authorities at the tourist destination and the carriers shall be considered as relevant.

 

f) The contract, or general terms and conditions, should also include declarations by the traveler.

79) The traveler received these general terms and conditions of the package travel contract prior to its conclusion. They are also permanently available at https://magna-expeditions.com/en/info-eng/terms-and-conditions

80) These general terms and conditions of the package travel contract are an integral part of each individual package travel contract. By signing the contract, you warrant that you have read and understood these general terms and conditions of the package travel contract.

81) These scanned and signed general terms and conditions of the package travel contract can be sent by post to the organizer at Peršćanski put 6a, 10 040 Zagreb, or, if sent electronically, a simple confirmation email to stating that the General Terms and Conditions have been received will suffice. This confirmation email shall have the same legal effect as a signed document.

82) Traveler's signature acknowledging receipt and understanding of these general terms and conditions of the package travel contract.
